New Rules Clarify Sick Leave During Vacation for Employees
A new clarification on sick leave during vacation has been issued for employees and employers. The rules outline how illness affects scheduled leave and the steps involved. Both parties must follow the process to ensure compliance with the law. When an employee falls ill during their annual leave, they must open a sick leave certificate. This automatically extends their vacation by the number of days covered by the certificate. The employer receives the electronic certificate directly through the Social Fund system, eliminating the need for extra paperwork.
Sick pay is provided for the days of illness, as stated in Article 9 of Federal Law No. 255-FZ. The employee can then decide whether to take the remaining leave days immediately or save them for a later date. The company must respect the employee’s choice on how to use these extended days.
If the sick leave is taken to care for a child or another family member, the vacation does not get extended or postponed. In this case, no benefits are paid for the period of care. The system ensures a smooth process for extending leave due to illness. Employees retain the right to choose how to use their remaining days. Employers must adhere to the legal requirements without additional applications or delays.
